WAIVER OF LIABILITY, RELEASE, ASSUMPTION OF RISK & INDEMNIFYING AGREEMENT

For and in consideration of participant's being allowed to participate in Throwback Boxing, LLC facility, and activities, the participant or parents) or legal guardian(s) of participant waives, releases and relinquishes any and all claims and causes of action against damage or wrongful death occurring to participant arising out of participation in boxing, kickboxing, mixed martial arts (MMA) or sparring and/or engaging in any physical exercise, class or any other activity or use of any club equipment or facility on the premises, or off the premises, wherever or however they occur, and by this agreement any such claims, rights, and causes of action that participant may have are hereby relinguished and the participant or parents)/guardian(s) does(do) so on behalf of my/our and participant's heirs, personal representatives, administrators and assigns. Participant and/or participant's parents)/guardian(s) acknowledge, understand and assume all risks inherent in boxing, kickboxing, mixed martial arts (MMA), sparring and/or engaging in any physical exercise, class or any other activity or use of any club equipment or facility on or off the premises, and understand that said activities involve risks to participant's person including bodily injury, partial or total disability, paralysis, death and damages which may arise therefrom and that I/we have full knowledge of said risks. These risks and dangers may be caused by the negligence of the participant or the negligence of others, including the "releasees" identified below. It is further acknowledged that there may be risks and dangers not known or are not reasonably foreseeable at this time. Participant and/or participant's parents)/guardian(s) acknowledge, understand and assume the risks, if any, arising from the conditions and use of the equipment, gym, ring and related premises and acknowledges and understands that included within the scope of this waiver and release is any claim and cause of action, arising from the performance, or failure to perform maintenance, inspection, supervision or control of said areas and for the failure to warn of dangerous conditions existing at said gym, for negligent selection of certain releases, or negligent supervision or instruction by releases. Participant and/or participant's parents) /guardian(s) acknowledges to voluntarily participating in activities and use of the facilities and premises (including the parking lot) and assumes all risk of injury, illness, damage or loss that might result, including, without limitation, any loss or theft of any property. "Releasees" includes Throwback Boxing, LLG, its agents, officers, directors, employees, coaches, trainers and representatives, and other participants, and owners and operators of the premises and parking lot and owners, operators, hosts and participants of any event off premises. Participants or participant's parents)/guardian(s) agree if any claim, including but not limited to participant's medical bills, wage loss, personal injury or wrongful death is commenced against releases, he/she shall defend, indemnify (including payment of releases attorney fees), and save harmless releasees from any and all such claims or causes of action by whoever or whenever made or presented.
